The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords September 25, 2014 SPR14/492 Ms. Diane Lawton, Esq. Office of Consumer Affairs and Business Regulation 10 Park Plaza, Suite 5170 Boston, MA 02116 Dear Attorney Lawton: I have received the petition of Colman M. Herman appealing the nonresponse of the Office of Consumer Affairs and Business Regulation (OCABR) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Herman requested Undersecretary Barbara Anthony's expense reports and credit card statements (including back-up receipts) that she incurred on behalf of the state for the period January 1, 2013 to the present. Having received no response, Mr. Herman petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. OCABR is advised that all records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff, you agreed to provide a written response to the request. Whereas OCABR has agreed to provide a written response, made in compliance with the Public Records Law and its Regulations, I will consider this administrative appeal closed. Mr. Herman may appeal any subsequent response mad y OCABR within ninety (90) days. See 950 C.M.R. 32.08(2). Supervisor of Records cc: Mr. Colman M.
