Downey Cape Light Compact Post Office Box 427 Barnstable Superior Court House Barnstable, MA 02630 Dear Ms. Downey: I have received the petition of Eric Bibler appealing the response of the Cape Light Compact (Compact) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Bibler requested a copy of a letter that was referenced at an April 17, 2013 meeting of the Compact. In your response you denied the request, citing the attorney-client privilege. Whereas an interpretation of the Open Meeting Law falls within the authority of the Office of the Attorney General (AGO) and not this office, I decline to provide a determination as to the status of a document that was referenced in an open session of a public body. It is recommended that you contact the AGO should you seek a determination on this issue.
