The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A Williams Supervisor ofR ecords March 16, 2015 SPRlS/008 Mr. Jeremy Warnick Director of Communications & Media Relations Cambridge Police Department 125 Sixth Street Cambridge, MA 02142 Dear Mr. Warnick: I have received the petition of John Hawkinson appealing the nonresponse of the City of Cambridge Police Department (Department) to his request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Hawkinson requested seven (7) categories of records. Subsequent to receiving copies of records provided in response to this request, Mr. Hawkinson requested clarification by the Department to justify redaction of portions of street addresses in one of the records provided in response to Request 7. Mr. Hawkinson also requested information regarding docket numbers responsive to Request 7 that were not included in the Department's response. Having received no additional response, Mr. Hawkinson appealed. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § lO(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. The Department is advised that all records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Despite numerous attempts made by Mr. Hawkinson to obtain the clarification he sought, the Department failed to respond. Accordingly, the Department is hereby ordered, within ten (10) days of this order, to provide to Mr. Hawkinson the clarification he requested with respect to Request 7. If the Department maintains that any portion of the responsive records are exem t from disclosure it must provide Mr. Hawkinson a written explanation, with specificity, how pa cular exemption applies to each redacted or withheld record. This administrative appeal is closed. cc: Mr. John Hawkinson OneAshburton Place, Room 1719, Boston, Massachusetts 02108 · (617) 727-2832. Fax (617) 727-5914 www.sec.state.ma. us/ pre
