The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords May 19,2015 SPRlS/201 Lieutenant Michael McCarthy Boston Police Department Office of Media Relations One Schroeder Plaza Boston, MA 02120-2014 Dear Lieutenant McCarthy: I have received a petition appealing the nonresponse of the Boston Police Department (Department) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Ms. Maya Shaffer of the Bay State Examiner requested a copy of the identification photo for a specifically identified Department employee. Having received only an acknowledgment of her request, Ms. Shaffer appealed to this office. On May 14,2015 you informed an attorney on my staffthat the Department has provided Ms. Shaffer with the responsive photo. The Department is reminded that in the future, that the Department must respond to a public records request as soon as it is practicable, and always within ten (1 0) calendar days. G. L. c. 66, § 10 (a); 950 C.M.R. 32.05(2). The response should be an offer to provide the records, a denial which cites the exemption that applies to withhold the record(s), or an estimate detailing the costs to obtain the records. Accordingly, whereas the Department has provided the record, I will consider this administrative appeal closed. aw Supervisor of Records cc: Ms. Maya Shaffer OneAshburton Place, Room 1719, Boston, Massachusetts 02108 · (617) 727-2832 ·Fax (617) 727-5914 www.sec.state.ma. us/pre
