The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords July 14, 2015 SPRlS/340 Chief David A. Armstrong Town of Holden- Police Department 1370 Main Street Holden, MA 01520 Dear Chief Armstrong: I have received the petition of Michael Dreslinski appealing the response of The Town of Holden Police Department (Department) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Dreslinski requested a "copy of a "master record sheet". The Department responded by providing him with a good faith fee estimate of five dollars ($5.00) for the provision of records responsive to his request. Thereupon, Mr. Dreslinski filed his petition questioning the reasonableness of the fee estimate. Under the Public Records Access Regulations (Regulations) a records custodian must provide a written estimate of fees for copying, search time and segregation time where costs of complying with a public records request is expected to exceed ten dollars ($10.00). 950 C.M.R. 32.06(2). In your response the estimated fees do not exceed ten dollars; therefore, a written, good faith estimate is not required. Accordingly, I find that this response was prepared in compliance with the Public Records Law and Regulations. One the Department receives payment the responsive records must be provided in a ti y m n . illiams SupervisM ofRecords cc: Mr. Michael Dreslinski OneAshburton Place, Room 1719, Boston, Massachusetts 02108 · (617) 727-2832 ·Fax (617) 727-5914 www.sec.state.ma. us/ pre
