Williams Supervisor ofR ecords September 4, 2015 SPRlS/649 Captain John Mullin Pittsfield Police Department 3 9 Allen Street Pittsfield, MA 01201 Dear Captain Mullin: I have received the petition of Ms. Maya Shaffer appealing the nonresponse of the City of Pittsfield- Police Department (City) to her request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Ms. Shaffer requested "All records related to the arrest of Phyllis Stankiewicz on June 25 and all records related to the arrest of Keith Stringer on August 20, 2014 while recording Dale Easton at a traffic stop." Having received no response, Ms. Shaffer petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. City is advised that all records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff and several conversations with Ms. Erica Phillips, who identified herself as Administrative Assistant from the Pittsfield Police Department Records Division, this office was notified that a response will be forthcoming, dated August 26, 2015. With the proviso that City will provide a response within 10 days, whereas this matter was opened based uponthe City's failure to provide a written response, I will now consider this administrative appeal closed. Ms. Shaffer may appeal the substantive nature of the City's response within ninety (90) days.
