The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor of& cords October 15, 2015 SPRlS/682 Chief Gary Sullivan Town of Easton Police Department 46 Lothrop Street North Easton, MA 023 56 Dear Chief Sullivan: I have received the petition of Brian Keaney appealing the nonresponse of Town of Easton Police Department (Department) to his request for public records. G. L. c. 66 § 1 O(b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Keaney requested copies of records regarding an incident occurring at Stonehill College on or about February 15, 2015. The basis of Mr. Keaney's appeal is that the Department required him to use a special form when he made his records request. Please be advised that a written request is not required but is recommended. An oral request made in person (not by telephone) is permitted. To appeal the records custodian's response to the Supervisor, however, a request must be in writing. There is no specific form that must be used to request records, nor is there any language that must be included in such a request. A records custodian may provide a form, but cannot demand that the form be used. Requests for public records may be oral or written. Written requests may be submitted in person or by mail. 950 CMR 32.05. This appeal is now closed. cc: Mr. Brian Keaney OneAshburton Place, Room 1719, Boston, Massachusetts 02108 · (617) 727-2832 ·Fax (617) 727-5914 www.sec.state.ma. us/pre
