Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Krupanski: I have received the petition of Maya Shaffer of the Bay State Examiner appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to her request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). It must be noted that Ms. Shaffer's petition did not contain a copy of her original request made to the MBTA. Ms. Shaffer is hereby advised that appeals to the Supervisor of Records must include a copy of the letter by which the request was made. 950 CMR 32.08(2). In a response dated September 15,2015 the MBTA provided Ms. Shaffer with a screen shot that which was published on a blog site used by the Transit Police Department. In this response you explained that the underlying video had been erased in the normal course of business. The MBTA is hereby advised that the retention is one month for surveillance videos. See Statewide Records Retention Schedule F-3 Audio/Visual Tape or Digital Recording. Given that Ms. Shaffer's petition did not contain a copy of the letter by which the request was made this office will not opine on the public status of any outstanding records that may have been responsive to her original request.
