Box 362 526 Maple Street Hathorne, MA 0193 7 Dear Ms. Teixeira: I have received the petition of Alan Leo appealing the nonresponse of Essex Agricultural and Technical High School (School) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Leo requested "All materials and exhibits used by the school committee in open meeting since March of 2015 and all district communication to and from auditing firms, including engagement letters and unsent drafts. Minutes of all school committee meetings In June of2012. All auditor reports received in calendar year 2014 and 2015." Having received no response, Mr. Leo petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (1 0) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. School is advised that all records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff, this office was notified by Mr. Joshua R. Coleman representing the School that a response will be provided by November 2, 2015. With the proviso that School will provide a written response by November 2, 2015, whereas this matter was opened based upon the School's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Leo rna appeal the substantive nature of the School's response within ninety (90) days.
