Williams Supervisor of& cords December 31, 2015 SPRlS/843 Interim City Marshal Christopher McDonald Newburyport Police Department 4 Green Street Newburyport, MA 01950 Dear Interim City Marshal McDonald: I have received the petition ofHazem Mahmoud, MD, PhD, appealing the response of the City of Newburyport Police Department (Department) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Dr. Mahmoud requested copies of records the Department maintains in which he is identified. In a response dated October 1, 2015 the Department denied his request in its entirety, claiming that the responsive records are exempt from disclosure citing to Exemption (f), the investigatory exemption to the Public Records Law. G. L. c 4 § 7(26)(f). In a December 29, 2015 telephone conversation you informed me that the Department mailed to Dr. Mahmoud copies of responsive records, via certified mail, dated December 29, 2015. Accordingly, I will consider this administrative a eal losed.
