Milanoski Town Administrator Town of Carver 108 Main Street Carver, MA 02330 Dear Mr. Milanoski: I have received the petition of Robert Belbin appealing the response of the Town of Carver (Town) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Belbin requested a copy records regarding Southern Sky Renewable Energy (SSRE) and the Town on the costs of fire equipment. Upon receiving a fee estimate from the Town, Mr. Belbin appealed. Subsequent to the opening of this appeal, in a telephone discussion with an attorney on my staff on December 16, 2015 you explained that Mr. Belbin revised his request. Mr. Belbin now seeks the records disclosing the costs of the fire equipment paid by SSRE or through a "PILOT" agreement. You informed both Mr. Belbin and this office that no such record yet exists. You further explained that the Town is likely to have the information responsive to this request by mid-January 2016, and will provide such records to Mr. Belbin at that time. To assist the Town in responding to future requests, particularly with respect to the preparation of fee estimates, I have enclosed a copy of our publication, A Guide to the Massachusetts Public Records Law.
