A review ofthe documents you submitted to this office reveals that the request for records was sent to a non-governmental entity, HSH Associates. Given that your request was not made to a government entity, we are unable to assist you in this appeal at this time. A governmental entity means, "any authority established by the General Court to serve a public purpose, any department, office, commission, committee, council, board, division, bureau, or other agency within the Executive Branch of the Commonwealth, or within a political subdivision of the Commonwealth. It shall not include the legislature and the judiciary." See 950 C.M.R. 32.03 (Definitions). You are advised to make a public records request to MassDOT directly. If you do not receive a response within ten (1 0) days, or receive an unsatisfactory response, you may petition this office for an appeal. Such appeal shall be in writing, and shall include a copy of the letter by which the request was made. The supervisor shall accept an appeal only from a person who has made his or her request in writing. An oral request, while valid as a public records request pursuant to 950 CMR 32.05 (3), may not be the basis of an appe under 950 CMR 32.08. Accordingly, this administrative appeal is closed.
