Williams Supervisor ofR ecords December 24, 2015 SPRlS/863 Mr. Steven Anderstrom Tax Collector Town of Holland 27 Sturbridge Road Holland, MA 01521 Dear Mr. Anderstrom: I have received the petition of Peter Frei appealing the response of Town of Holland Tax Collector (Town) to his request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). In a previous appeal, Mr. Frei requested the history of unpaid property and excise taxes of a specifically named individual in Holland, Massachusetts. An administrative order was sent which required the Town to provide more detail on its estimate, and inform Mr. Frei whether the record provided is the only record held by the Tax Collector. See SPR15/407 Supervisor of Records Determination (September 18, 20 15). On October 13, 2015, you stated that as of April22, 2015 the specifically named individual did not own any other properties with unpaid balances, and did not have any unpaid excise taxes. Further, you stated that there was a typographical error on the original estimate and so the Town changed the fee to twenty dollars and seventy cents ($20.70). You also explained that you would refund Mr. Frei one dollar and forty cents ($1.40) for the envelope and postage. Upon receipt of this October letter, Mr. Frei appealed and informed this office that he found the letter to be umesponsive to the Supervisor of Records' Determination on September 18. In a telephone discussion with an attorney on my staff on December 14,2015, you explained that you have searched the records from 2003-2015 for unpaid property and excise taxes, however the only record found was the record provided to Mr. Frei. Furthermore, you state that the estimate provided for search time, which included time to print the responsive record was due to the search from 2003-2015. You informed this office that you would confirm this information in a letter to Mr. Frei and copied to this office.
