Assistant District Attorney Middlesex District Attorney's Office 15 Commonwealth A venue Woburn, MA 01801 Dear Attorney Kilcoyne: I have received the petition of William Najjar appealing the response of the Middlesex District Attorney's Office (Office) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Najjar requested various categories of records regarding two specifically identified Office employees. In a previous response, the Office provided certain information regarding the first employee. You indicated the Office was still in the process of searching for additional information regarding the second employee and explained there is no one record responsive to this portion of the request. You further stated that fulfilling this request requires searching through numerous boxes. Mr. Najjar petitioned this office, indicating he has yet to receive this information about the second employee. I understand the Office is continuing to locate records responsive to the portion of the request pertaining to the second employee and will contact Mr. Najjar by letter once the additional information is available. Whereas the Office intends to provide Mr. Najjar with the remaining responsive records, I will consider this administrative appeal closed with the proviso that the Office provides a substantive response to the remainder ofthe request, within ten (10) days, in a manner consistent with this determination, the Public Records Law, and its Access Regulations. If there are any fees associated with this response a written, good faith estimate must be provided. G. L. c. 66, § 10(a); see also 950 C.M.R. 32.06(2) (where cost of complying with a request for public records is expected to exceed ten dollars ($10.00), custodian of records shall provide written good faith estimate).
