Belson City of Medford - Public Schools 489 Winthrop Street Medford, MA 0215 5 Dear Mr. Belson: I have received the petition of Joseph Viglione appealing the nomesponse of City of Medford (City)-Public Schools (Schools) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Viglione requested records from a number of incidents occurring in or relating to the Schools. Having received no response, Mr. Viglione petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (1 0) days of the request. G. L. c. 66, § 1O (b ); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. Both the City and Schools are advised that all records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff, you notified this office in a January 22, 2016 email that the City Solicitor will provide a written response to this request. Whereas this matter was opened based upon the Schools' failure to provide a written response, I will consider this administrative appeal closed, with the proviso that a response be provided within ten (10) days. Mr. Viglione may appeal the substantive nature ofthe City's response within ninety (90) days. See 950 C.M.R. 32.08(2). To assist the Schools in responding to requests for public records I have enclosed a copy of our publication, A Guide to the Massachusetts Public Records Law.
