Williams Supervisor ofR ecords March 23, 2016 SPR16/177 Ms. Diane Silva Records Access Officer Department of Corrections 50 Maple Street, Suite 3 Milford, MA 01757 Dear Ms. Silva: I have received the petition of Richard Kachadorian appealing the nonresponse of the Executive Office ofPublic Safety and Security- Department of Corrections (Department) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Kachadorian is requesting "demographic information for each male second-degree murder inmate in the Mass. DOC's custody for each year, from January 1, 2006 to January 1, 2016, including commitment date, date of birth, and race." Having received no response, Mr. Kachadorian petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § lO(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision ofthe records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the opening of this appeal, this office was notified by you that a written response was provided. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Kachadorian may appeal the substantive nature ofthe Town's response within ninety (90) days. See 950 C.M.R. 32.08(2).
