Williams Supervisor ofR ecords April22, 2016 SPR16/247 Mr. Nick Cannata Records Access Officer-Research and Planning Division Department of Correction Concord, MA 01 7 4 2 Dear Mr. Cannata: I have received the petition of Richard Kachadorian appealing the response of the Department of Correction (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Kachadorian requested records contained in the Inmate Management System. You responded to Mr. Kachadorian stating that the Department does not readily keep all the data he requested. Mr. Kachadorian appealed your response. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (1 0) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to a conversation with a member of my staff, you indicated you would provide Mr. Kachadorian with a revised response to his request. I will now consider this administrative appeal closed with the proviso that the response is issued within ten (1 0) days of this order. Mr. Kachadorian may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2).
