Deputy Chief Legal Counsel Office of the Governor State House, Room 271 Boston, MA 0213 3 Dear Attorney Judd-Stein: I have received the petition of Matt Fenlon on behalf of Michael Cantor of WayF orward Research appealing the responses of the Office of the Governor (Office) to requests for records. You denied this request, citing a holding from the Supreme Judicial Court indicating that records of the Governor are not "expressly included" in the list of instrumentalities identified in the Public Records Law. Lambert v. Executive Dir. of the Judicial Nominating Council, 425 Mass. 406, 409 (1997). Accordingly, whereas based upon the holding in Lambert the responsive records are not subject to disclosure under the Public Records Law I will consider this administrative appeal closed. It should be noted, therefore, that the Office acted properly by not advising Mr. Cantor of any administrative remedies associated with denial of access to public records under the Public Records Law.
