Williams Supervisor ofR ecords June 21, 2016 SPR16/373 Ms. DueyKo1 Chair, Board of Trustees Lowell Community Charter Public School 206 Jackson Street Lowell, MA 01852 Dear Ms. Kol: I have received the petition of Amelia Pak-Harvey, on behalf of The Lowell Sun, appealing the response of the Lowell Community Charter Public School (School) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Ms. Pak-Harvey requested records associated with a severance agreement. The School provided a copy of a separation agreement and general release to Ms. Pak-Harvey. Ms. Pak-Harvey then requested any additional information that would determine the salary of the employee to aid in her determination of "the amount" of severance pay to be provided. No other records were provided and Ms. Pak-Harvey appealed. In a June 20, 2016 telephone conversation School counsel Elka T. Sachs, Esq., of Krokidas & Bluestein LLP explained that no record yet exists containing the severance amount, as the payments will not commence until July 2016; however, the School does possess payroll records and would provide them if deemed responsive.
