Deputy General Counsel Department of Capital Asset Management and Maintenance One Ashburton Place, 15th Floor Boston, MA 02108 Dear Attorney McMahon: I have received the petition of Colman Herman appealing the nonresponse of the Executive Office for Administration and Finance (ANF) - Department of Capital Asset Management and Maintenance (DCAMM) to his request for public records. G. L. c. 66 § IO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Herman requested a copy of the listed yacht clubs by the current price tiers, along with the new price tiers that the yacht clubs will be in when the new leases go into effect; the "boat club methodology." This particular record was previously provided to Mr. Herman; however here-requested the record, from ANF, by email on May 8, 2016. Having received no response, Mr. Herman petitioned this office. On June 16, 2016, an attorney on my staff contacted you by telephone and email, including a copy of the appeal to assist DCAMM in responding. On June 17, DCAMM provided Mr. Herman with a response along with a copy of the requested record. DCAMM waived any applicable fees allowed by the Public Records Law Access Regulations. Whereas this matter was opened based upon DCAMM's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the DCAMM's response within ninety (90) days.
