Deputy Chief Legal Counsel Department of State Police General Headquarters 4 70 Worcester Road Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Anthony Cristallo appealing the nomesponse of the Department of State Police (Department) to his May 16, 2016 request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Cristallo requested all records related to a specifically named individual, including two (2) aliases that this individual may have used. Mr. Cristallo previously requested these records and the Department provided a response on December 7, 2015, explaining that the Department has four records responsive but is withholding those records pursuant to the Criminal Offender Records Information Act (CORI). Mr. Cristallo has appealed the Department's non-response to his May 16, 2016 request. Subsequent to the intervention by a member of my staff, this office was notified that a response will be provided. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Cristallo may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2).
