Dear Ms. Polhemus:

I have received the petition of Shirley Kressel appealing the response of the Boston Redevelopment Authority (BRA) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Ms. Kressel requested “copies of the appraisals of the Winthrop Square Garage.” In a response dated June 3, 2016 you denied her request, claiming

that responsive records are exempt from disclosure under Exemption (i) of the Public Records Law. G. L.c. 4, § 7(26)(i).

In a recent determination I found the BRA had not met its burden to withhold the responsive record pursuant to Exemption (i) of the Public Records Law. See SPR16/376 Determination of the Supervisor of Records (June 14, 2016). I understand the BRA provided a response to that order and intends to provide a similar response to Ms. Kressel.

Accordingly, I will consider this appeal closed with the proviso that the BRA provide Ms. Kressel a response to her request without delay in a manner consistent with this order, the Public Records Law, applicable case law and prior determinations from this office. A copy of sucha response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
