The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords June 30, 2016 SPR16/436 Chief David A. Armstrong Town of Holden Police Department 1370 Main Street Holden, MA 01520 Dear Chief Armstrong: I have received the petition of Michael Dreslinski appealing the response of the Town of Holden Police Department (Department) to a March 3, 2016 payment for records regarding prior requests for records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). In a letter to Mr. Dreslinski dated April4, 2016 the Department responded to an inquiry "the select Holden Police records specified for purchase by my March 3, 2016 correspondence", that a thorough search of all correspondence the Department had received from Mr. Dreslinski produced nothing bearing the date March 3, 2016. In addition the Department can identify no estimate provided to him for the amount of the check he submitted. The Department explained the check is being withheld pending clarification from Mr. Dreslinski. I find the Department has used its superior knowledge of its files to assist in complying with this request. 950 C.M.R. 32.05(4). Once Mr. Dreslinski provides the Department with the requested proper clarification the Department is ordered to prov.ide the requested records. ~ Supervisor of Records cc: Mr. Michael Dreslinski OneAshburton Place, Room 1719, Boston, Massachusetts 02108 · (617) 727-2832 ·Fax (617) 727-5914 www.sec.state.ma. us/ pre
