Dear Superintendent Kearney:

I have received the petition of John Robert Powers appealing the nonresponse of Boston Emergency Medical Services (EMS) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.MLR. 32.08(2). Specifically, Mr. Powers requested a copy of records related to a 2014 EMS report. Having received no response Mr. Powers petitioned this office.

In a June 30, 2016 telephone conversation you notified this office that a response to Mr. Powers’ request will be promptly provided. Whereas this matter was opened based upon the EMS failure to provide a written response, I will now consider this administrative appeal closed.

Mr. Powers may appeal the substantive nature of the EMS response within ninety (90) days. See 950 C.M.R. 32.08(2).
