Taub Senior Staff Attorney City of Boston - Police Department One Schroeder Plaza Boston, MA 02120-2014 Dear Attorney Taub: I have received the petition of Joshua Eaton appealing the response of City of Boston Police Department (Department) to a June 19, 2015 request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Eaton sought copies of Department correspondence. In response the Department stated it had "no records responsive to this request." Mr. Eaton appealed. This request was the subject of a previous appeal and determination. See SPR15/565 Determination ofthe Supervisor of Records (October 5, 2015, June 23, 2016). The basis of Mr. Eaton's appeal is his belief that responsive records do exist. In my June 23 determination I ordered the Department to review its records and Mr. Eaton's requests to confirm whether it possesses any responsive records. In a July 1 email to the Department Mr. Eaton stated he had not yet received a response from the Department associated with my June 23 order. In a July 13 telephone conversation you indicated that you would conduct the necessary review to ensure a complete response to Mr. Eaton's request. To assist, my office provided to you a copy of the entire file associated with Mr. Eaton's request and appeal. Based on our telephone conversation I will consider this appeal closed with the proviso that the Department complete its review without delay and provide a written response to Mr. Eaton, prepared in a manner consistent with the Public Records Law and its Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Eaton may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2). it~ Shawn A.
