Executive Office of Public Safety and Security Department of State Police Office of the Chief Legal Counsel 470 Worcester Road Framingham, MA 01702 Dear Mr. Rooney: I have received the petition of Mr. John Rousseau appealing the nonresponse of the Department of State Police (Department) to his request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Rousseau requested records related to a specifically identified "Suspicious Person/MY incident" as well as records related to a specifically identified "Crime Scene Services Section case." Having received no response, Mr. Rousseau petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified that a response will be provided. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the Department provide a response. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rousseau may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2).
