General Counsel Executive Office of Public Safety and Security Department of Correction 70 Franklin Street, Suite 600 Boston, MA 02110-1327 Dear Attorney White: I have received the petition of Emory Snell, Jr., appealing the response of the Executive Office of Public Safety and Security (Office) to a May 29, 2016 request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Snell requested copies of2014 correspondence between you and Mr. Snell. As of the date ofhis petition to this office Mr. Snell had not received any response from the Office regarding his May 29 request. In a July 18, 2016 telephone conversation a member of the Department of Correction Legal Department staff explained that it did not possess a copy of Mr. Snell's May 29 request. To assist I will provide a copy of the file associated with this appeal as an attachment to the Office's copy of this determination. Whereas this matter was opened based upon the Office's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the Office review and respond to Mr. Snell's request. Mr. Snell may appeal the substantive nature of the Office's response within ninety (90) days. See 950 C.M.R. 32.08(2). y~ Shawn A.
