Williams Supervisor ofR ecords July 18,2016 SPR16/519 Mr. Joseph Fahey Director of Facilities Town of Auburn School Department 5 West Street Auburn MA 01501 Dear Mr. Fahey: I have received the petition of Arthur Butler of The Foundation for Fair Contracting of Massachusetts appealing the response of Town of Auburn School Department (Department) to his requests for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Butler has made requests for copies of records related to an interior renovations project for the Auburn Middle School, including: 1. certified payroll records submitted by Antonelli Construction Company, Inc. and all subcontractors as required by G. L. c. 149 §27B and; 2. All applicable minimum wage schedules as required by G. L. c. 149 §27. As of the date ofhis petition to this Office, Mr. Butler states he had not received responsive records. Subsequent to the intervention by a member of my staff, this office was notified that a response will be provided. You further indicated that you would contact Mr. Butler by telephone. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Butler may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2). Very truly yours, ~ Shawn A.
