Diaz appealing the response of the Executive Office of Health and Human Services-Department of Public Health (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, B. Diaz requested "all the applications pertaining to MA License #278008 ." Initially you responded on July 15, 2016 informing B. Diaz that "DPH has no records that are responsive to your request". On that same day, B. Diaz petitioned this office contending, "every nurse has applications. It is questionable even ifthey searched for them at all.". Subsequent to the intervention by a member of my staff, this office was notified by a DPH staff member that a subsequent response will be provided. I will now consider this administrative appeal closed with the proviso that such response be provided to B. Diaz, who may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2). A copy of such response must be provided to this office.
