Burwell Executive Office of Administration and Finance Office of Information Technology One Ashburton Place, Room 804 Boston, MA 021 08 Dear Ms. Burwell: I have received the petition of Jim Haddadin of the Me trow est Daily News appealing the nomesponse of the Executive Office of Administration and Finance - Office of Information Technology (Office) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Haddadin requested "copies of all email communications sent or received by employees of the Office oflnformation Technology in connection with [Mr. Haddadin's] Aug. 26, 2015 request for public records and/or the two appeals that stemmed from that request (SPR15/877 and SPR16/307)." Having received no response, Mr. Haddadin petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (1 0) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Despite being provided with an acknowledgement letter for the opening of this appeal dated July 19, 2016 and a copy ofthe file, the Office has failed to respond to the request. Accordingly, the Office is hereby ordered without delay to review the request made by Mr. Haddadin and provide a written response to Mr. Haddadin, made in accordance with the Public Records Law, its Access Regulations and this order. Mr. Haddadin may appeal the substantive nature of the Office's response within ninety (90) days. See 950 C.M.R. 32.08(2).
