Macy, Esq. City of Fall River Office of the Corporation Counsel One Government Center Fall River, MA 02722 Dear Attorney Macy, I have received the petition of Mr. C.J. Ferry appealing the nonresponse ofthe City of Fall River (City) to his request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Ferry requested records related to Penrose Commercial and a specifically identified individual. Having received no response, Mr. Ferry petitioned this office. Subsequent to the opening of this appeal, this office was notified that a response is being compiled and will be provided. Whereas this matter was opened based upon the City's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the City provide Mr. Ferry with a response. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@lsec.state.ma.us.
