Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Krupanski: I have received the petition of Carlo Cellai, Esq. appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Attorney Cellai requested several categories of records related to InMotion Wireless, Inc. The MBTA provided certain responsive records in a response dated July 21, 2016 stating the MBTA "cannot locate any further records." Attorney Cellai appealed to this office indicating his belief that additional responsive records exist. Subsequent to the intervention of this office you explained that the MBTA would provide a supplemental response to this request with respect to whether any other records exist. Accordingly, I will consider this appeal closed with the proviso that the MBTA provide Attorney Cellai with a revised response to the request, prepared in a manner consistent with this the Public Records Law and its Access Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec. state.ma. us.
