Dear Ms. Flanagan: .

[have received the petition of S. Howey appealing the nonresponse of the City of Attleboro — Police Department (Department) to his/her request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, S. Howey requested several records related to police reports and 911 calls. Having received no response, S. Howey petitioned this office.

Subsequent to the intervention by a member of my staff, this office was notified that you never received the original request, as it was directed to the Fire Department, but that you will begin to process the request and respond to S. Howey accordingly. In an email dated August 17, 2016, you informed this office that you had attempted to contact S. Howey regarding this request but that the messages were being returned as undeliverable.

Whereas this matter was opened based upon the Department’s failure to provide a written response, I will now consider this administrative appeal closed with the proviso that the Department provide a response without delay. S. Howey is encouraged to contact the Department to provide contact information to assist the Department in its response. S. Howey may appeal the substantive nature of the Department’s response within ninety (90) days. See
