Assistant Corporation Counsel City of Boston - Law Department City Hall, Room 615 One City Hall Square Boston, MA 02201 Dear Attorney Zuares: I have received the August 14, 2016 petition of Shirley Kressel appealing the nomesponse of the City of Boston-Law Department (City) to an August 1, 2016 request for public records. G. L. c. 66 § IO(b); see also 950 C.M.R. 32.08(2). Specifically, Ms. Kressel requested copies of records for a specified period related to the Winthrop Square garage. Having received no response, Ms. Kressel petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § lO(b); 950 C.M.R. 32.05. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of a response. In an August 15, 2016 email to this office you explained that Ms. Kressel's request was sent via email to a City employee who is out on leave. You further stated that the City will provide a response. Accordingly, I will consider this appeal closed with the proviso that the City provides Ms. Kressel a written response to her request without delay, prepared in a manner consistent with the Public Records Law, its Regulations, and this order. A copy of such a response must be provided to this office.
