Deputy General Counsel/ MassDOT Ten Park Plaza, Suite 3510 Boston, 02116 Dear Mr. Caldarelli: I have received the petition of Jean and Marsby Warters appealing the response of Massachusetts Department of Transportation (Department) to an August 18,2016 request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, Ms. Warters requested copies of appraisals for several specifically identified parcels. In an August 19, 2016 you denied this request, citing an exemption to the Public Records Law associated with real estate appraisals. G. L. c. 4, § 7 (26) (i). Jean and Marsby Warters appealed. Subsequent to the opening of this appeal this office was copied on an email between you and Jean and Marsby Warters. In this email you explained that you initially misunderstood the scope of the original request; attached to the email you provided .pdf copies of the responsive records. Accordingly, I will consider this administrative appeal closed. Jean and Marsby Warters may appeal the substantive nature of the Department's response within ninety (90) days.
