Younger Town of Swampscott-Town Administrator 22 Monument A venue Swampscott, MA 01907 Dear Mr. Younger: I have received the petition of Glenn Kessler appealing the non-response ofthe Town of Swampscott-Town Administrator (Town) to his request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, on May 9, 2016, Mr. Kessler requested copies of three categories of records. This appeal is based on Mr. Kessler's public records request, and the Town's failure to comply with my July 19 determination. During a conversation on July 19, you explained that the Town provided all the records in existence regarding Request 1 and Request 2, and you stated you would determine whether the Town has any records responsive to Request 3. See SPR16/476 Supervisor of Records Determination (July 19, 2016). The Town has failed to do so, and Mr. Kessler appealed for the second time. Mr. Kessler informed this office that he has not been provided with any records responsive to Request 2 and Request 3. I find the Town has failed to respond to a request for public records. Accordingly, the Town is hereby ordered, without delay, to review Mr. Kessler's request and provide a written response without delay. A copy of any such response must be provided to this office.
