The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords September 7, 2016 SPR16/664 Ms. Christine Matton Fall River Police Department Office of the Chief of Police 685 Pleasant Street Fall River, MA 02721-4305 Dear Ms. Matton: This office has received a petition from Ms. Lisa Munger appealing the response of the Fall River Police Department (Department) to her request for copies ofrecords related to Department service calls to a particular address on a specifically identified date in 1996. This request was the subject of a previous appeal. See SPR 16/3 78 Determination of the Supervisor of Records (June 20, 2016). I closed the appeal with the proviso that the Department prepare a revised response, include copies of any approved application for destruction forms relating to the requested records. The Department provided Ms. Munger with a response in compliance with this order, explaining that there were no longer any responsive records in the custody of the Department. The Department provided Ms. Munger with a copy of the Commonwealth of Massachusetts Municipal Records Retention Manual (Manual) and a copy of the inventory of purged records that included the records requested by Ms. Munger. In subsequent correspondence with this office, Ms. Munger requested this office take further action with respect to this appeal. In a September 6 telephone conversation with a member of my staff, you confirmed that the Department has no responsive records. Further, you agreed to provide Ms. Munger with a revised response to her request explaining that there are no records responsive to her request. For the reasons discussed above, I will consider this administrative appeal closed with the proviso that the Department provided a response to Ms. Munger in a manner consistent with this order, the Public Records Law and the Regulations. The response must reference sections of the Manual that specifically relate to the records requested, citing the retention period required by OneAshburton Place, Room 1719, Boston, Massachusetts 02108 · (617) 727-2832 ·Fax (617) 727-5914 . www.sec.state.ma.us/pre Ms. Christine Matton SPR16/664 Page2 September 7, 2016 the Manual.
