Williams Supervisor ofR ecords August 26, 2016 SPR16/668 Chief Mark Duphily Town of Carver Police Department 112B Main Street Carver, MA 02330 Dear Chief Duphily: I have received the petition of Mr. Mark Kominsky appealing the response of the Carver Police Department (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Kominsky requested several records in which he is specifically identified. On July 29, 2016 you denied his request, citing Exemption (f). The Public Records Law strongly favors disclosure by creating a presumption that all governmental records are public records. G. L. c. 66, § 10(c); 950 C.M.R. 32.08(4). "Public records" is broadly defined to include all documentary materials or data, regardless of physical form or characteristics, made or received by any officer or employee of any town of the Commonwealth, unless falling within a statutory exemption. G. L. c. 4, § 7(26). Subsequent to the intervention by a member of my staff you explained that you would review his request to determine whether any responsive records could be provided Mr. Kominsky. Accordingly, whereas the Department has agreed to review and provide an additional response to Mr. Kaminsky's request I will now consider this administrative appeal closed.
