Williams Supervisor ofR ecords September 7, 20 16 SPR16/673 Mr. Sean Medeiros Superintendent MCI-Norfolk 2 Clark Street PO Box43 Norfolk, MA 02056 Dear Mr. Medeiros: I have received the petition of William Duclos appealing the nomesponse ofMCI Norfolk Executive Office of Public Safety and Security (Office) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, in requests dated May 31 and July 11, 2016 Mr. Duclos requested a number of records regarding the Health Service Unit at MCI-Norfolk. Having received no response, Mr. Duclos petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. In a telephone conversation with a member of my staff, your office stated that a search for the responsive records has commenced and a written response to Mr. Duclos will follow. Whereas this matter was opened based upon the Office's failure to provide a written response, and further whereas the Office has indicated it will comply with the provisions of the Public Records Law with a proper response, I will consider this appeal closed with the proviso that the Office provides a response to Mr. Duclos within ten (1 0) days.
