Curran Town of Billerica-Town Manager 365 Boston Road Office #207 Billerica, MA 01821 Dear Mr. Curran: I have received the petition of Chris Courtney appealing the nonresponse ofthe Town of Billerica-Office of the Town Manager (Town) to a July 19, 2016 request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, in his July 19 email, addressed to you, Mr. Courtney requested three categories of records related to Town Hall window replacement and masonry repairs. Having received no response Mr. Courtney appealed. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. In a telephone conversation with a member of my staff, confirmed via email, a staff member from your office stated a request would be provided. Whereas this matter was opened based upon the Town's failure to provide a written response, I will consider this appeal closed with the proviso that the Town review the request and provide a written response in a manner consistent with the Public Records Law, its Access Regulations and this Order.
