Assistant General Counsel Department of Conservation and Recreation 251 Causeway Street, Suite 900 Boston, MA 02114-2119 Dear Attorney Connelly: I have received the petition of Colman Herman appealing the response of the Department of Conservation and Recreation (DCR) to an August 3, 2016 request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Herman copies of records associated with Community Boating. Other than an August 5, 2016 acknowledgment Mr. Herman received no other response from DCR until August 30, 2016. Subsequent to the August 30 response Mr. Herman modified his request. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § IO(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. DCR is reminded it must comply with the timeliness requirements of the Public Records Law. In its August 30 response DCR indicated it had no responsive records. In a followup email Mr. Herman modified his request. Subsequent to Mr. Herman's communication it is my understanding that DCR intends to review and provide any responsive records. Accordingly, I will consider this administrative appeal closed. Mr. Herman rna appeal the substantive nature ofDCR's response within ninety (90) days. See 950 C.M.R. 3 08(2).
