The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords September 16, 2016 SPR16/692 Ms. Nancy J. Lowell Town Clerk Town of Warren 48 High Street, P.O., Box 603 Warren, MA 01083 Dear Ms. Lowell: I have received the petition of Michael Baril appealing the response of the Town of Warren (Town) to his request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, On April26, 2016 Mr. Baril requested copies of records specific to a Town Police Department employee. Previous appeal This request was the subject of a previous appeal. See SPR16/522 Determination of the Supervisor ofRecords (July 19, 2016). In my July 19 determination I ordered the Town to review Mr. Baril's request and provide Mr. Baril with a written response, prepared in a manner consistent with this order, the Public Records Law and its Access Regulations (Regulations). The Town responded to this order in a letter dated August 12, 2016. Mr. Baril informed this office he seeks further action with respect to this matter and this appeal (SPR16/692) was opened as a result. Unclear if all responsive records provided A review of the correspondence provided with this appeal indicates it is unclear whether the Town has searched all Town departments to determine if a responsive "internal memo" exists. The Town must conduct a search of other relevant departments including, but not limited to, the Town's Board of Selectmen. Conclusion Accordingly, I will consider this appeal closed with the proviso that the Town review Mr. Baril's request, perform a search of Town records, and provide Mr. Baril with a written response detailing the result of that search. Such written response must be prepared in a manner consistent with this order, the Public Records Law and its Regulations.
