Williams Supervisor ofR ecords September 12, 2016 SPR16/697 Ms. Neha Dhupar Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3 510 Boston, MA 02116 Dear Ms. Dhupar: I have received the petition of Heather Carito appealing the nonresponse of Massachusetts Department of Transportation (Department) to two August 1, 2016 requests for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Ms. Carito requested a number of records pertaining to the "Casey Arborway project," and the "Forest Hills MBTA station." Department Legal Counsel provided an acknowledgment letter in this response dated August 11, 2016. No further response was provided. Ms. Carito appealed both the failure to respond as well as the Department's failure to acknowledge the second of the two August 1 requests. Subsequent to the intervention by a member of my staff, this office was notified by you via a September 9, 2016 email as well as through a phone conversation that a response will be provided to both requests. Whereas this matter was opened based upon the Department's failure to provide a written response,. I will now consider this administrative appeal closed. Ms. Carito may appeal the substantive nature of the Department's response ithin ninety (90) days.
