Senior Assistant Corporation Counsel City of Boston - Law Department City Hall, Room 615 Boston, MA 02201 Dear Ms. Driscoll: I have received the petition of Elliott Turner appealing the nomesponse of the City of Boston-Law Department (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Turner requested records from January 1, 2012 to July 20, 2016 pertaining to "the possible construction of a soccer stadium to be used by the New England Revolution soccer team". Initially Department provided an email response acknowledging the receipt of his request on July 21, 2016 but having received no further response, Mr. Turner petitioned this office on September 1. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff, this office was notified by you on September 12, 2016 that you have received a copy ofthe file and will be looking into this matter. With the proviso that Department will provide a response to Mr. Turner without delay, whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Turner may appeal the substantive nature of the Department's response within ninety (90) days.
