Deputy General Counsel/ MassDOT 10 Park Plaza, Suite 3 510 Boston, MA 02116 Dear Attorney Caldarelli: I have received the petition of Jean and Marsby Warters seeking further consideration of my previous written determination regarding Massachusetts Department of Transportation's (Department) response to a request for public records. See SPR16/654 Determination of the Supervisor of Records (August 31, 2016). In my August 31, 2016 determination, I closed the appeal upon being notified that responsive records were provided. In subsequent correspondence with this office, Jean and Marsby Warters request this office take further action with respect to this appeal, as they had not yet received responsive records. Subsequent to this request for appeal, this office was copied on an email between you and Jean and Marsby Warters. In this email, you provide them with further responsive records and explain that all responsive records have been provided. Accordingly, I will consider this administrative appeal closed. Jean and Marsby Warters may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2).
