Neiswanger Chief of Police Holyoke Police Department 138 Appleton Street Holyoke, MA 01040-5706 Dear ChiefNeiswanger: I have received the petition of Hector Guillen, also known as Pedro Alvarez appealing the response of the Holyoke Police Department (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Guillen requested copies of records related to a 1992 investigation. This request was subject of a prior appeal. See SPR15/912 Determination of the Supervisor of Records (December 22, 2015). Upon receipt of a fee estimate for provision of records Mr. Guillen paid the fee and received copies of records. In the present appeal Mr. Guillen states he received 134 pages, many of which were duplicates or blank. Further, Mr. Guillen states he paid a fee estimate for 600 pages. In order to determine whether Mr. Guillen received all records and whether he is entitled to a refund, the Department must review his request. Accordingly, I will consider this appeal closed with the proviso that the Department review the request, the Department's response and determine whether all records are provided, whether any records remain that must be provided, and whether Mr. Guillen is entitled to a refund. A copy of any such response must be provided to this office.
