Assistant Attorney General Office of the Attorney General Executive Bureau-General Counsel's Office One Ashburton Place Boston, MA 02108 Dear Attorney Tarrow: I have received the petition of Kate R. Cook, Esq. of Sugarman, Rogers, Barshak & Cohen, P.C. appealing the response of the Office of the Attorney General (AGO) to a request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). On June 14, 2016 Attorney Cook requested a copy of records that were collected or generated in connection with a report issued by the Office of the Inspector General titled, "A Report on Certain Activities and Practices of the Massachusetts Public Health Biologic Laboratories" and dated December 1996. Specifically, Attorney Cook provided a description of the records requested and the AGO responded with a fee estimate to review its records and provide any responsive records. Attorney Cook appealed. Subsequent to recent separate telephone conversations both with Attorney Cook and you, it is unclear what records, if any, are in the custody of the AGO that would be responsive to Attorney Cook's request. I find the AGO must perform a cursory review of its records to determine whether it possesses any records responsive to Attorney Cook's request. Once this cursory review has concluded the AGO must provide a revised response to Attorney Cook's request, prepared in a manner consistent with this order, the Public Records Law and its Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at ec.statl a.us. Supervisor of Records cc: Ms. Kate R.
