Macy, Esq. City of Fall River Office of the Corporation Counsel One Government Center Fall River, MA 02722 Dear Mr. Macy: I have received the petition ofC.J. Ferry appealing the response ofthe City of Fall River (City) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Ferry requested several records related to Penrose Commercial and a specifically identified individual. In a letter dated August 18, 2016 you responded to Mr. Ferry's request, providing him with "the Agreement made between Penrose Commercial and the City of Fall River on March 22, 2016; the Letter of Award dated March 1, 2016, Price Proposal dated February 9, 2016, Penrose Commercial References services information, References, Non Collusion Affidavit dated February 9, 2016 and City payments ledger dated July 22, 2016." Mr. Ferry contacted his office on September 28, 2016 to appeal this response, as no documents were enclosed with your letter. Subsequent to the intervention by a member of my staff, this office was notified that the documents were inadvertently omitted from the package sent to Mr. Ferry. You agreed to provide him with copies of the referenced documents. For these reasons, I will now consider this administrative appeal closed with the proviso that the City provide t e remaining responsive records to Mr. Ferry. cc: Mr. C. J.
