Wells Senior Business Analyst Concord Public Schools Concord-Carlisle Regional School District 120 Meriam Road Concord, MA 01742 Dear Mr. Wells: I have received the petition of ChrisP. Courtney of The Foundation for Fair Contracting appealing the response of the Concord-Carlisle Regional School District (School District) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Courtney requested a copy of all records pertaining to the bidding of a project regarding a General Contract for the Concord-Carlisle High School Athletic Renovations Phase I Project No. BD01664/716040). In a July 21, 2016 email you replied to Mr. Courtney, "There are no records responsive to your request as the district did not contract with RAD Sports/RAD Corp. This company contracted with a private entity that leased the district property." Mr. Courtney appealed. Upon review, it is unclear whether any responsive records exist. Accordingly, I find the School District must review Mr. Courtney's request and provide a revised written response, prepared in a manner consistent with this order, the Public Records Law and its Regulations. In this response the School District must clarify any confusion between Mr. Courtney's request and the School District's response. A copy of any such response must be provided to this office.
