Assistant Attorney General Office of the Attorney General One Ashburton Place, 20th Floor Boston, MA 021 08 Dear Attorney Tarrow: I have received the petition of Harris Contos appealing the response of the Office of Attorney General (AGO) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Contos requested copies of complaints related to violations of the "Do Not Call" law for a specific period. In its August 16 response the AGO explains "[w]e have determined that the AGO has no records that are responsive to your request. Please be advised that the Massachusetts Statewide Records Retention Schedule requires that we keep such records for a retention period of six years, after which time they may be destroyed." Mr. Contos appealed, requesting the AGO perform another search. In a telephone conversation with a member of my staff you confirmed the AGO has no responsive records. I find the AGO acted appropriately in its review of and response to Mr. Contos' request.
